1. Acceptance of Terms

By accessing or using TX DPS Alerts ("the Service"), operated by LIGHTHOUSE 27 LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TX DPS Alerts is an appointment monitoring and notification service that:

  • Monitors the Texas Department of Public Safety appointment scheduler for available appointments
  • Sends email alerts when appointments matching your preferences become available
  • Provides informational guides about TX DPS processes

Important: We are an independent service and are not affiliated with or endorsed by the Texas Department of Public Safety (TX DPS) or the State of Texas.

3. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement.

4. Account Registration

To use the Service, you must:

  • Provide a valid email address
  • Select your appointment preferences (type and region)

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

5. Subscription Plans

5.1 Free Plan

  • 1 email alert per day
  • All appointment types (Road Test, New License, Renewal)
  • No cost

5.2 Pro Plan ($9.99/month)

  • Up to 5 email alerts per day
  • All appointment types (Road Test, New License, Renewal)
  • 3-hour cooldown between alerts
  • Billed monthly via Stripe

6. Payment and Billing

  • Paid subscriptions are billed monthly in advance
  • Payment is processed securely through Stripe
  • Subscriptions automatically renew unless canceled
  • You can cancel anytime - access continues until the end of your billing period
  • No refunds for partial months
  • Price changes will be communicated 30 days in advance

7. Service Limitations and Disclaimers

7.1 No Guarantee of Alerts

While we make every effort to monitor appointments reliably, we do not guarantee:

  • That you will receive an alert for every available appointment
  • That appointments will still be available when you receive an alert
  • That the Service will be uninterrupted or error-free
  • That all appointments will be detected by our monitoring system

7.2 Alert Timing

  • Alerts are sent during business hours (6 AM - 6 PM Central Time)
  • Monitoring runs every 30 minutes, but appointment availability changes rapidly
  • Email delivery times vary based on provider and network conditions

7.3 Third-Party Dependency

Our Service depends on:

  • The availability and accuracy of the TX DPS appointment system
  • Third-party services (SendGrid, Stripe, Cloudflare)
  • Internet connectivity and telecommunications networks

We are not responsible for failures caused by third-party systems or services.

8. User Responsibilities

You agree to:

  • Use the Service legally: Do not use automated tools, bots, or scripts to interact with the Service
  • Provide accurate information: Keep your contact information and preferences up to date
  • Book appointments fairly: Do not abuse the Service to monopolize appointments or resell them
  • Respect rate limits: Do not attempt to circumvent daily alert limits
  • Comply with DPS policies: Follow all TX DPS rules when booking and attending appointments

9. Prohibited Uses

You may not:

  • Use the Service for any illegal purpose
  • Resell or redistribute alerts to others
  • Reverse engineer, decompile, or attempt to extract source code
  • Interfere with or disrupt the Service or servers
  • Use multiple accounts to circumvent plan limits
  • Impersonate others or provide false information
  • Spam, harass, or send unsolicited messages through our communication channels

10. Intellectual Property

All content, features, and functionality of the Service (including text, graphics, logos, and software) are owned by LIGHTHOUSE 27 LLC and are protected by copyright, trademark, and other intellectual property laws.

TX DPS data is provided by the State of Texas and is public information. We do not claim ownership of government data.

11. Termination

  • Use the Service fraudulently or illegally
  • Fail to pay subscription fees
  • Abuse or misuse the Service

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIGHTHOUSE 27 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

14. Indemnification

You agree to indemnify and hold harmless LIGHTHOUSE 27 LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
